Terms of Service

Welcome to BuddyPlay. These Terms of Service ("Terms") govern your access to and use of the BuddyPlay mobile application ("the App"), operated by BuddyPlay ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Description of Service

BuddyPlay is an AI-powered casual gaming platform featuring four mini-games:

• AI Guess Word: An AI asks up to 20 questions to guess the word you're thinking of.
• AI 24-Point Challenge: Use four given numbers to reach 24 using basic arithmetic, with AI judging and providing hints.
• AI Text Adventure: An interactive branching narrative with AI voice narration.
• AI Dice Game: A dice-rolling game with point-based wagering against the AI.

The App also includes Buddy, an AI companion that provides personalized interactions based on your gameplay.

2. Eligibility

You must be at least 13 years of age to use the App. If you are between 13 and 18 (or the age of majority in your jurisdiction), you must have a parent or legal guardian's consent to use the App and agree to these Terms on your behalf. By using the App, you represent and warrant that you meet these eligibility requirements.

3. User Accounts

To access the App, you must create an account using your email address or Google sign-in. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate and complete registration information
• Keep your account information up to date
• Notify us immediately of any unauthorized use of your account
• Not share your account credentials with any third party

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse engineer, decompile, or extract the App's source code
• Interfere with or disrupt the App's servers, networks, or functionality
• Use automated means (bots, scripts, scrapers) to access or interact with the App
• Exploit bugs, glitches, or vulnerabilities to gain unfair advantages
• Harass, abuse, or harm other users or BuddyPlay personnel
• Upload or transmit viruses, malware, or any malicious code
• Use the AI features to generate harmful, illegal, or offensive content

5. Virtual Points and In-App Economy

The App includes a virtual points system for gamification purposes. In the current version (v1.0), points are earned solely through gameplay and daily login bonuses. Points have no real-world monetary value and cannot be redeemed for cash, goods, or services outside the App.

In future versions, we may introduce the ability to purchase points with real currency. Any such changes will be communicated to you and will be subject to applicable consumer protection laws.

6. Intellectual Property

BuddyPlay and all related names, logos, designs, code, graphics, audio, game mechanics, and AI character personas are the exclusive property of BuddyPlay and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

You retain ownership of any content you create within the App (such as chat messages to Buddy). By submitting content, you grant us a worldwide, royalty-free license to use, reproduce, and process that content solely for the purpose of providing and improving the App's services.

7. Third-Party Services

The App integrates with third-party services including Firebase (Google) for authentication and data storage, and MiniMax AI for game AI and text-to-speech functionality. Your use of these services is also subject to their respective terms and policies:

We are not responsible for the content, practices, or availability of third-party services.

8. AI-Generated Content

Some features of the App use artificial intelligence to generate responses, narratives, and voice content. AI-generated content may occasionally be unpredictable, inaccurate, or inconsistent. We do not guarantee the accuracy, appropriateness, or reliability of AI-generated content. You use AI features at your own discretion.

We reserve the right to filter, moderate, or block AI-generated content that violates these Terms or applicable laws.

9. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:

• Merchantability and fitness for a particular purpose
• Uninterrupted, error-free, or secure operation
• Accuracy or reliability of AI-generated content
• Compatibility with all devices and operating system versions

10. Limitation of Liability

To the maximum extent permitted by applicable law, BuddyPlay and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App, including but not limited to data loss, device damage, or emotional distress, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising from your use of the App shall not exceed the amount you have paid us (if any) in the twelve months preceding the claim, or one hundred US dollars (USD $100), whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless BuddyPlay and its affiliates from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your infringement of any third-party rights.

12. Termination

We may suspend or terminate your account and access to the App at any time, with or without cause, and without prior notice. Grounds for termination include but are not limited to violation of these Terms, fraudulent activity, or extended account inactivity.

You may terminate your account at any time by contacting us. Upon termination, your right to use the App ceases immediately. We will delete your personal data in accordance with our Privacy Policy.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or via email at least 14 days before the changes take effect. Your continued use of the App after the effective date of changes constitutes your acceptance of the updated Terms.

We encourage you to review these Terms periodically.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved through good-faith negotiation first. If negotiation fails, the dispute shall be submitted to binding arbitration in Hong Kong in accordance with the HKIAC rules.

Nothing in this section prevents you from seeking injunctive relief in a court of competent jurisdiction, or from raising claims that may not be subject to arbitration under applicable law.
